Kathmandu \u2014 The National Human Rights Commission (NHRC) is set to “soon” recommend action to the government against those found guilty of human rights violations during the Generation Z movement that took place on Bhadra 23 and 24. According to the Commission, the groundwork for finalizing the report is in its final stages, and the report has identified then-Prime Minister KP Sharma Oli, then-Home Minister Ramesh Lekhak, and Chief of Army Staff Ashokraj Sigdel, along with other officials of the National Security Council, as culpable.<\/p>\n

Commission Spokesperson Dr. Tikaram Pokhrel informed that the report will soon be submitted as a recommendation to the government. “We will recommend action to the government as soon as possible. The Commission is currently engaged in this very groundwork,” he stated. He also clarified that the report will be made public following the recommendation. “The National Human Rights Commission does not submit a report to the government; that is not our mandate. We make recommendations to the government, and we also publish reports on specific incidents for public information,” Spokesperson Pokhrel said.<\/p>\n

The investigation committee formed by the Commission under the coordination of member Dr. Lili Thapa has prepared a report spanning nearly 600 pages. During this process, the Commission’s study team and provincial offices conducted on-site studies in 45 districts and monitored all 77 districts. The Commission also stated that a forensic examination of hundreds of CCTV footage from the two days of events was carried out.<\/p>\n

The report concludes that the National Security Council failed to perform its role effectively during the Generation Z movement. The National Security Council, chaired by the Prime Minister, includes the Defense Minister, Home Minister, Foreign Minister, Finance Minister, Chief Secretary, and the Chief of Army Staff as members. During the Generation Z movement, then-Prime Minister KP Sharma Oli was the Chairman of the Council, while then-Deputy Prime Minister and Finance Minister Bishnu Prasad Paudel, Home Minister Ramesh Lekhak, Foreign Minister Dr. Arzu Rana Deuba, Defense Minister Manbir Rai, Chief Secretary Eknarayan Aryal, and Chief of Army Staff Ashokraj Sigdel were members.<\/p>\n

According to Commission sources, the report has specifically named and recommended action against officials of the National Security Council and many others for human rights violations. “Once the Commission endorses the report, the recommendations will be forwarded for implementation,” a source informed.<\/p>\n

During the preparation of the report, the Commission recorded statements from Oli and Lekhak, as well as then-Minister for Communications Prithvi Subba Gurung, then-Inspector General of Nepal Police Chandrakubar Khapung, and Armed Police Force Inspector General Raju Aryal, among others. Similarly, statements were also taken from former Home Minister and Rastriya Swatantra Party Chairman Rabi Lamichhane, then-Mayor of Kathmandu Metropolitan City Balen Shah, and artists Dipak Raj Giri and Nischal Basnet.<\/p>\n

The report has also drawn conclusions regarding the failure to implement a special security plan, and the use of excessive and lethal force all at once, rather than applying a graduated use of force for crowd control. Commission sources indicated that those involved in such actions have also been recommended for action.<\/p>\n

The Commission stated that during its investigation, it also conducted a detailed study on the role of the leaders of the Generation Z movement and those leading the protests on the streets. “Preparations made prior to the Bhadra 23 protests have also been minutely examined. Messages and videos circulated on various social media platforms were also studied. During this process, activities such as instructions on making bombs and sharing maps pinpointing the homes and offices of leaders and businessmen were found on platforms like Discord,” the source revealed.<\/p>\n

The Commission source also stated that the autopsy reports obtained by the Commission indicated that almost all of those who died from police gunfire on Bhadra 23 sustained bullet wounds above the waist.<\/p>\n

The Generation Z movement, demanding an end to corruption and the establishment of good governance, turned violent, resulting in the death of 76 individuals. Previously, the interim election government led by Sushila Karki had formed an investigation commission under the chairmanship of former Justice Gauri Bahadur Karki. That commission had recommended criminal action against then-Prime Minister Oli and Home Minister Lekhak. Following the elections, the day after a new government was formed under the leadership of Balen Shah, i.e., on the morning of Chait 14, Oli and Lekhak were released after 13 days in custody.<\/p>\n
