His statement that Nepal was his final destination has raised serious questions extending far beyond one individual\u2019s journey, particularly concerning the ease with which third-country nationals may move unlawfully across the Nepal\u2013India border.<\/p>\n<p>According to Indian police, Brown was intercepted near Border Pillar No. 516 in the area under the Bhagwanpur police post of Sonauli Kotwali in Maharajganj district. Instead of using the designated Sonauli\u2013Belahiya immigration route, he was reportedly proceeding toward Nepal along a local footpath. Indian media reported that he attempted to flee after security personnel signalled him to stop but was subsequently taken into custody.<\/p>\n<p>Police said Brown was carrying no passport, visa or official document establishing his identity at the time of his arrest. During questioning, he reportedly claimed that he was from California, had travelled to nearly 70 countries and had studied at the University of California. He also claimed to have served for six years in the US Navy and special forces before leaving the military around two years ago. However, neither the US government, the Department of Defense nor the US Embassy has confirmed his military service or rank. There is therefore no verified basis for describing him as a serving US Navy commander.<\/p>\n<p>Brown reportedly told investigators that he had entered India from Bali, Indonesia, in May 2026, spent around six weeks in Goa and then travelled to Bengaluru. According to his account, he left Bengaluru by bus on July 8, travelled to Lucknow and then Gorakhpur, before reaching Sonauli by taxi.<\/p>\n<p>He said he was travelling to Nepal to meet a Nepali citizen named \u201cNaz,\u201d whom he claimed to have met in Goa. However, he was unable to provide the person\u2019s full name, address in Nepal or verifiable contact details. He also claimed that his passport was with another acquaintance in Bengaluru but could not provide clear information about that individual either.<\/p>\n<p>Following inconsistencies in his statements, Indian police and security agencies began investigating his identity, travel route, stay in India and actual purpose for attempting to enter Nepal. He was sent to judicial custody after the US Embassy was informed of the case.<\/p>\n<p>Indian media reports have not been consistent even about his name. The Times of India identified him as Jordan Brown, while another Indian publication referred to him as Sam Brown. As no official identity document was recovered and US authorities have yet to confirm his identity, referring to him for the time being as Jordan Brown (Sam Brown) appears to be the most factually responsible approach.<\/p>\n<p>The most sensitive aspect of the case is that Nepal was reportedly Brown\u2019s final destination. He was not arrested merely while travelling within India. He was detained while allegedly attempting to evade formal immigration procedures and enter Nepali territory. Had he not been intercepted, he could potentially have travelled through Rupandehi and moved deeper into Nepal.<\/p>\n<p>This was not an isolated incident. At the beginning of July 2026, a 37-year-old Ukrainian national, Oksana Shevtsova, was arrested near Raxaul in Bihar while allegedly attempting to enter Nepal without a valid passport, visa or immigration documents. She had reportedly travelled to Raxaul from Delhi. Indian authorities launched an investigation into her travel route and whether she had any connection with a possible human-trafficking network.<\/p>\n<p>In 2025, Iraqi national Bara Fawzi Hamid al-Bayati was arrested while attempting to enter Raxaul in India from Birgunj, Nepal. He did not possess the visa required to enter India. According to Indian police, he had previously entered India unlawfully from Nepal, travelled through several Indian cities and was arrested while attempting to return to Nepal.<\/p>\n<p>Indian officials also reported that, during the same period, nine foreign nationals from the United States, China, Canada, South Korea and Iraq were detained at different times in the Raxaul area while attempting to enter India from Nepal without valid documents.<\/p>\n<p>Similarly, in May 2025, two Chinese nationals were arrested while attempting to enter India through the Papraun\u2013Jatahi area after travelling from Janakpur in Nepal. Although they possessed valid tourist visas for Nepal, they did not have the documents required to enter India. They had reportedly travelled through Kathmandu and Pokhara before reaching Janakpur. The case demonstrated how foreign nationals who legally enter one country may attempt to evade immigration procedures when crossing into another by using local routes.<\/p>\n<p>These incidents demonstrate that third-country nationals have used unauthorised routes in both directions, from India into Nepal and from Nepal into India. Those who are arrested cannot be assumed to represent the full scale of unlawful cross-border movement. The Government of Nepal does not regularly publish consolidated figures on foreigners who successfully cross the border undetected, remain in the country after their visas expire or do not appear in official entry and departure records.<\/p>\n<p>The Nepal\u2013India border is neither entirely open nor uncontrolled. Nepal Police, the Armed Police Force, India\u2019s Sashastra Seema Bal, customs offices, immigration authorities, land ports and local administrative bodies are deployed across the border regions of both countries.<\/p>\n<p>The special travel arrangements available to citizens of Nepal and India are a separate matter. Those arrangements do not apply to American, Ukrainian, Chinese, Iraqi or other third-country nationals.<\/p>\n<p>Citizens of third countries are required to cross through designated entry points with valid passports and visas and complete all immigration procedures. A foreign national crossing through a footpath, agricultural field, rural road or secondary crossing is therefore not exercising a right to facilitated movement but violating immigration law.<\/p>\n<p>Describing the Nepal\u2013India border simply as an \u201copen border\u201d obscures the presence of security, customs and immigration institutions operating there. The real problem is not that the border is open, but that its management is uneven and poorly coordinated.<\/p>\n<p>Although security agencies and immigration offices operate at major crossings, continuous surveillance of the hundreds of local paths, agricultural areas, riverbanks and rural roads between them has not been possible. Third-country nationals, human traffickers, narcotics smugglers and other criminal networks may exploit precisely these gaps.<\/p>\n<p>The Brown case has also revived questions about the number of refugees, asylum seekers and foreign nationals who entered Nepal unlawfully and continue to reside in the country.<\/p>\n<p>There have been claims in various circles that nationals of more than 36 countries, including the United States, are living in Nepal as refugees or asylum seekers. However, the latest publicly available records from the Government of Nepal and the Office of the United Nations High Commissioner for Refugees do not clearly provide a separate figure for US citizens or an updated country-by-country list covering all 36 nationalities.<\/p>\n<p>The number and nationality of such individuals can be established conclusively only after the relevant government agencies or United Nations bodies publish disaggregated data.<\/p>\n<p>A clear distinction must also be made between \u201crefugees arriving from the United States\u201d and \u201crefugees who are US citizens.\u201d<\/p>\n<p>Some Bhutanese refugees who were resettled in the United States under third-country resettlement programmes were later deported and returned toward Nepal. Although they arrived from the United States, they were not necessarily US citizens. Their underlying status remained that of Bhutanese refugees or stateless persons.<\/p>\n<p>In 2025, reports emerged that some Bhutanese refugees deported from the United States had re-entered Nepal through India after Bhutan refused to accept them.<\/p>\n<p>No reliable and current public data are available on the number of actual US citizens who have sought asylum in Nepal. Refugees, asylum seekers, foreign nationals overstaying their visas and individuals entering by evading border controls are also not part of the same legal category.<\/p>\n<p>A person seeking international protection from war, persecution or a threat to life may qualify as a refugee or asylum seeker. Entering on a valid visa and remaining beyond the authorised period constitutes an immigration violation. Entering a country through an unauthorised trail without any official record is a separate and potentially more serious offence.<\/p>\n<p>Treating all such individuals as a single group weakens both the protection of genuine refugees and the country\u2019s national security.<\/p>\n<p>The Jordan Brown (Sam Brown) case raises several direct questions for Nepali authorities.<\/p>\n<p>First, how effective is the mechanism for receiving immediate information from Indian security agencies about third-country nationals whose final destination is Nepal?<\/p>\n<p>Second, does Nepal have an integrated national system for identifying foreigners who successfully enter through unauthorised routes?<\/p>\n<p>Third, do Nepal Police, the Armed Police Force, the Department of Immigration, customs offices and local governments exchange information on the movement of foreign nationals in real time?<\/p>\n<p>The answer to poor border management is not the complete restriction of cross-border movement. Communities on both sides of the Nepal\u2013India border maintain deep family, social, cultural and economic relations. These ties must be preserved while introducing a clear, technology-based monitoring system for the movement of third-country nationals.<\/p>\n<p>Digital passport screening at major entry points, checks against international databases of stolen and lost travel documents, a shared watchlist of suspicious foreign nationals, proper records from border-area hotels and transport operators, and regular surveillance of unauthorised routes are increasingly necessary.<\/p>\n<p>Without an immediate information-sharing mechanism between the security and immigration authorities of Nepal and India, it remains difficult to determine when, how and for what purpose a foreign national who entered one country travelled into the other.<\/p>\n<p>Nepal must also establish a clear national legal and administrative framework for separately managing refugees, asylum seekers, stateless persons, visa violators and unauthorised entrants.<\/p>\n<p>The rights of those genuinely requiring humanitarian protection must be safeguarded. At the same time, activities that exploit the status of a refugee or tourist to evade immigration procedures cannot be tolerated.<\/p>\n<p>Further investigation will determine whether Jordan Brown (Sam Brown) genuinely served in the US military, what his actual name is and whom he intended to meet in Nepal.<\/p>\n<p>The case has already exposed a broader reality: although the Nepal\u2013India border has formal security structures, gaps in its management continue to provide third-country nationals with opportunities for unauthorised cross-border movement.
