The Millennium Challenge Corporation, or MCC, is no longer merely a subject of political debate in Nepal. It has become a major infrastructure programme that has already entered the implementation phase. Signed in 2017, the compact was ratified by the House of Representatives on 27 February 2022, accompanied by a 12-point interpretive declaration, and its five-year implementation period commenced on 30 August 2023. With additional American grant funding, the MCC contribution has reached 550 million US dollars, while Nepal has committed 197 million dollars, bringing the total programme size to 747 million dollars. Work is currently underway on electricity transmission lines, three substations, a cross-border transmission segment connecting to India, and road maintenance projects.<\/p>\n

Yet the scale of funding and the promise of physical infrastructure do not, by themselves, resolve the questions that have surrounded the MCC from the outset. The real question is this: is Nepal implementing the programme according to its own national development priorities, or is it being gradually bound within an external policy framework that arrived alongside the grant?<\/p>\n

The most contentious aspect of the compact remains its legal status. The original agreement treats the MCC compact as an international agreement and stipulates that, in the event of any conflict between the compact and Nepal’s domestic laws, the provisions of the compact shall prevail. The interpretive declaration passed by parliament sought to reaffirm the supremacy of the constitution, Nepal’s non-alignment, and the application of Nepali law to the activities of MCA-Nepal. However, the declaration did not alter the actual text of the original agreement. Should a serious dispute arise in the future, how the relationship between the declaration and the original compact will be interpreted remains untested in practice. The government cannot afford to rest easy simply because “parliament has ratified it.” It must ensure, in every concrete decision, that constitutional supremacy is directly upheld.<\/p>\n

The question of project ownership and control is equally complex. MCA-Nepal is a development committee established by the Government of Nepal, and formal responsibility for implementation rests with it. Yet MCC oversight, approval authority, procurement standards and financial controls remain decisive within the compact’s structure. This is neither a project under total American control nor a fully domestic project operating through Nepal’s normal budgetary system. It is a distinctive structure of shared management, within which Nepal’s institutional capacity and negotiating power are under continuous test.<\/p>\n

The procurement question is no less sensitive. MCC’s formal procurement policy is based on open, fair, transparent and competitive processes, and no written clause grants automatic preference to American firms. At the same time, the fact that the American firm Deloitte secured a contract to provide technical assistance to the Electricity Regulatory Commission makes it impossible to deny the presence of American consultants. The core issue here is not merely the nationality of contractors. It is how much work Nepali contractors have received, the extent of participation by Nepali engineers and workers, and whether clear provisions exist for technology and knowledge transfer. If large contracts go to foreign firms without generating local employment and institutional capacity, the physical structures may remain in Nepal while a significant share of the economic benefit flows out. MCA-Nepal must regularly disclose details of primary contractors, subcontractors, ultimate beneficiaries, cost revisions and local procurement.<\/p>\n

The MCC cannot be viewed in isolation from Nepal’s broader relationship with the United States. Since 21 January 2026, the US has suspended the issuance of immigrant visas for nationals of several countries, including Nepal. There is no evidence that this decision constitutes a political sanction against Nepal or pressure linked to the MCC. Nevertheless, it signals that visa policy can serve as a strategic instrument for powerful states. In the security domain, recent joint exercises have focused primarily on search and rescue, disaster management, health assistance and technical exchange. These cannot automatically be taken as evidence of a military alliance. Yet the mandate, expenditure and long-term objectives of such cooperation must be made public. Secrecy and ambiguity only breed unnecessary suspicion.<\/p>\n

Another dimension of American soft power lies in educational exchanges, media engagement and cultural programmes. Such programmes are employed by most influential countries around the world. The problem is not the exchange itself; it arises when foreign assistance exerts opaque influence over Nepali media, research institutions or policymaking. It is in this context that questions have been raised about figures with international experience, such as Swarnim Wagle. However, an individual cannot be branded a representative of foreign interests merely because of a background linked to foreign institutions. Public figures must be judged not by their past employment, but by their present policy decisions, transparency, institutional affiliations and accountability to the national interest. The state must not delay in enacting robust conflict-of-interest legislation and a mandatory public disclosure system.<\/p>\n

The MCC transmission infrastructure aims to facilitate electricity trade with India. From an economic standpoint, India may well be Nepal’s immediate primary electricity market. But excessive dependence on a single market, a single transmission direction or a single external partner can generate future policy risk. Expanding trade with India must not come at the cost of weakening economic and infrastructure cooperation with China. Nepal must maintain transparent, project-based and non-aligned relations with both neighbours and with all partners.<\/p>\n

Rejecting the MCC outright is not nationalism, and accepting it without scrutiny is not developmentalism. Nepal’s true national interest lies not in accepting or refusing funds alone. It resides in constitutional supremacy, parliamentary oversight, procurement transparency, local employment, technology transfer, genuine Nepali ownership and an independent foreign policy. Nepal must engage in development partnerships. But a partnership commands respect only when the recipient country sets its own priorities, monitors agreements on its own terms, and never allows any grant to become a gateway to security or political alignment.<\/p>\n

The question, then, is no longer simply whether the MCC is a development project or a strategic venture. A more serious question now presents itself: does Nepal possess the capacity to conduct foreign assistance within the framework of its own national strategy, or is a situation gradually taking shape in which foreign strategy is mistaken for national development policy?<\/p>\n
