The government has removed Dan Bahadur Karki as Inspector General of Nepal Police, appointed him as the Prime Minister\u2019s security adviser, and named Additional Inspector General Manoj KC as the new police chief. The government spokesperson said Karki\u2019s responsibilities were changed following a party directive.<\/p>\n

The decision has revived not only memories of a leadership change in Nepal Police three decades ago, but also the longstanding question of where the political limits should lie on the power to remove a police chief before the end of his tenure. This issue is not unique to Nepal. In Brazil, a change in police leadership led to allegations of political interference and a Supreme Court investigation. In the United States, the dismissal of an FBI director exposed tensions between legal authority and institutional independence. In India, the Supreme Court issued directives calling for minimum tenure protections to shield police chiefs from arbitrary transfers.<\/p>\n

Disputes that intensified before the decision<\/h3>\n

Reports that Karki might be removed had circulated before the decision. He called a meeting of senior police officers and said no one had asked him to resign. Police also said some reports about his resignation were misleading. A few days later, the Cabinet decided to change his responsibilities.<\/p>\n

The background included controversy over the procurement of police uniforms and an incident in which police entered media offices and detained journalists. A direct causal link between these issues and the change in leadership has not been established. But the timing of the decision, the apparent differences between the government and police leadership, and the spokesperson\u2019s reference to a party directive call for a public explanation of the decision\u2019s basis and process.<\/p>\n

Brazil: Change in police leadership and allegations of interference<\/h3>\n

In 2020, Brazilian President Jair Bolsonaro removed federal police chief Mauricio Valeixo, prompting allegations of political interference in police investigations. Then-justice minister Sergio Moro resigned, saying the president had pressured him to change the police leadership. Brazil\u2019s Supreme Court authorized an investigation into the allegations. Bolsonaro denied them.<\/p>\n

The Brazilian case is not identical to Nepal\u2019s. In Brazil, the dismissal of the police chief was accompanied by allegations that the president had sought to interfere in investigations. In Nepal, the Cabinet\u2019s decision and the spokesperson\u2019s statement about a party directive have been made public. Yet both cases point to a similar institutional risk: when a police leadership change occurs amid active investigations, political controversy or disagreement with the government, a failure to explain the reasons can lead the public to view it as political control rather than an administrative decision. The distinction between allegations and established facts must be maintained.<\/p>\n

United States: A fixed term does not remove the power to dismiss<\/h3>\n

The FBI director\u2019s post in the United States has a term of up to 10 years. The limit was introduced to prevent one person from controlling the agency for an excessively long period. However, the US president retains the legal authority to dismiss the director. In 2017, President Donald Trump fired FBI Director James Comey, prompting controversy over the timing and reasons for the decision.<\/p>\n

The lesson is not that fixed terms are pointless. They can provide stability, but they do not make a leader impossible to remove. The exercise of removal powers requires clear reasons, legislative or institutional oversight, and public accountability. Having the legal authority to act and exercising that authority in a way that serves institutional interests are not the same thing.<\/p>\n

India: Judicial protection for a predetermined term<\/h3>\n

In the 2006 Prakash Singh case, India\u2019s Supreme Court directed that state police chiefs should generally receive a minimum two-year term. It also identified grounds on which they could be removed earlier, including disciplinary proceedings, conviction for a criminal offence, corruption, or incapacity to perform their duties. The Court proposed institutional safeguards to reduce the risks of political interference and arbitrary transfers.<\/p>\n

India\u2019s arrangement cannot simply be applied to Nepal; the two countries have different legal systems. But its relevant lesson is that predetermined terms, clear criteria for selecting police chiefs, and decisions supported by stated reasons can help insulate the office from shifting party politics.<\/p>\n

The 2053 precedent and how today\u2019s case differs<\/h3>\n

In Nepal, the present decision has been compared with the 2053 BS episode in which then-Inspector General Achyut Krishna Kharel was transferred to the National Investigation Department and Dhruva Bahadur Pradhan was appointed police chief. Nepal Police\u2019s historical records confirm that Kharel and Pradhan held the leadership post in succession in 1997. The similarity is that, in both cases, an incumbent police chief was moved to another role before the end of his tenure and a new leader was appointed.<\/p>\n

Historical parallels alone cannot determine whether today\u2019s decision is lawful. Kharel was transferred to a different security agency; Karki has reportedly been appointed the Prime Minister\u2019s security adviser. Without the written order explaining the legal provision and administrative grounds for today\u2019s decision, the two cases cannot be treated as identical.<\/p>\n

Authority must be matched by accountability<\/h3>\n

The Police Act, 2012, gives the government authority to take action against gazetted police officers. The Act also generally provides an opportunity for the officer concerned to present his case in disciplinary actions such as removal from office or demotion. The formal order should clarify whether Karki has been removed from the police service or merely transferred from the post of Inspector General to another role. The legal implications of these two situations may differ.<\/p>\n

The government has the authority to select police leadership and run the organization. But the statement that Karki\u2019s responsibilities were changed \u201cfollowing a party directive\u201d raises questions about the relationship between a party\u2019s decision and the Cabinet\u2019s constitutional responsibilities. A party may set its political position; the government, however, is responsible for demonstrating that a change in the leadership of a state security agency was made on legal and administrative grounds.<\/p>\n

A police chief is not above accountability. But disagreement with the government, or dissatisfaction with the pace of an investigation, should not by itself be grounds for changing the leadership. If the decision was based on performance, discipline or the public interest, the government should explain the reasons and the process it followed. Without that explanation, suspicion of political influence will deepen.<\/p>\n

International experience shows that many governments have the legal authority to remove police chiefs, but the credibility of that power depends on transparent reasons and institutional oversight. Nepal should not leave the 2053 controversy as a mere historical repetition. It should prompt a wider debate on clear criteria for selecting police chiefs, tenure stability and disclosure of the grounds for removal. Leadership can change; the impartiality of the police and public trust in the force must not be placed under party control.<\/p>\n
