The Cabinet\u2019s decision to remove Inspector General of Police Dan Bahadur Karki before the end of his term, appoint him security adviser to the prime minister, and name Additional Inspector General Manoj KC as police chief raises serious questions. The government has described the move as a reassignment. But the label attached to a decision matters less than its grounds, process and consequences. The government has the authority to change the leadership of a security agency, but it must exercise that authority within the law and on clear grounds.<\/p>\n

If the government was dissatisfied with Karki or believes he committed misconduct, it should make the basis for that view public. Reports about the Inam Sapkota case and instructions to make arrests have fuelled questions and concern. But claims reported in the media are not proof of guilt. Allegations about contact between Karki and Sapkota require an impartial investigation. The government should also explain whether changing the police leadership during an ongoing investigation could affect its course.<\/p>\n

The relationship between the provisions of the law and regulations governing the inspector general\u2019s term needs to be clarified. The government\u2019s statement that this was \u201ca change of responsibility, not disciplinary action\u201d does not resolve the legal questions. It should explain in writing why the new advisory post was created, what authority it carries, and what legal grounds justified moving a police chief who still had time left in his term. If the interpretation of the law is disputed, the courts should resolve the matter promptly.<\/p>\n

Nepal\u2019s history shows why changes in security leadership should not be treated lightly. In 1997, Inspector General of Police Achyut Krishna Kharel was removed early in his term and transferred to another post. His case remained pending in the Supreme Court for months; he was reinstated only after a change of government. In 2009, the government\u2019s decision to remove Army Chief Rookmangud Katawal triggered a constitutional confrontation between the president and the government, followed by the prime minister\u2019s resignation. The current case is not an exact repetition of those episodes. But history shows that when leadership of the security forces becomes a battleground for political rivalry, the consequences reach beyond the institution itself.<\/p>\n

In India, in 1983, Prime Minister Indira Gandhi\u2019s government passed over senior Lieutenant General S.K. Sinha and appointed A.S. Vaidya as army chief. The decision sparked controversy over seniority and political influence, and Sinha resigned. The restrictions on civil liberties and the media during the 1975 Emergency offer a broader warning: as state power accumulates at the centre, democratic institutions can weaken. These episodes should not be equated with Nepal\u2019s current situation. They do, however, underline why clear standards, institutional integrity and accountability matter when security leaders are appointed or replaced.<\/p>\n

Civilian control of the security forces is essential to democracy. But it does not mean that political leaders may direct professional institutions according to their wishes. Police officers must obey the law; governments must not ask them to act unlawfully. Professional disagreement and indiscipline are different matters, and each must be assessed through evidence and due process.<\/p>\n

If the Cabinet\u2019s decision is lawful, the government should publish its legal basis and address public doubts. If the decision contains a legal flaw, it should correct it. The investigation into the Inam Sapkota case must be protected from political pressure. If police leadership can be changed from one government to the next without clear grounds or safeguards, political loyalty risks becoming more important than competence and accountability.<\/p>\n

A state\u2019s strength is not measured only by its ability to replace a security chief. It is also measured by whether it can make such decisions while upholding the rule of law. The government must meet that test if Nepal\u2019s security institutions are to retain public confidence.<\/p>\n
